The Florida Real Estate Commission (FREC) was created to protect the public through education and regulation of Real Estate licensees. The Commission consists of seven members who are appointed by the Governor. The FREC meets monthly, typically for two days in duration, and scheduled on the third Wednesday of the month and the immediately preceding Tuesday. The FREC administers and enforces the real estate license law, which includes Chapter 475, Part I, Florida Statutes. The Commission is also empowered to pass rules that enable it to implement its statutorily authorized duties and responsibilities. These rules are contained in Chapter 61J2, Florida Administrative Code. The statute and rules, along with Chapters 455, 215, 120, and 20, Florida Statutes are available under Statutes and Rules.

The Department of Business and Professional Regulation (“DBPR”) supports the Governor in meeting his obligation to appoint qualified, representative and appropriate people to the important leadership roles within the Department’s Professional Boards, Council, and Commissions. Members are appointed by the Governor, subject to confirmation by the Senate.
DBPR does not handle or process Commission Member applications or requests.

FREC has very specific membership requirements for each appointed position. When completing the “Questionnaire for Gubernatorial Appointments” it is helpful if you indicate the board position that you are interested in, along with your specific qualifications for that position. The requirements are available under Section 475.02, F.S.

Unless otherwise indicated, Florida law prohibits board members from holding more than one public office and provides that no officer, director, or administrator of a Florida state, county, or regional professional association, may serve on a board that governs that profession.
Florida Real Estate Commission (FREC)
Description: The Florida Real Estate Commission (FREC) is headquartered in Orlando and consists of seven members. FREC is the regulatory body that protects the public by regulating real estate sales associates, brokers, schools and instructors. The powers and duties of FREC include regulating and enforcing license laws, enacting administrative rules, fostering education, approving applications, determining license law violations and administering penalties.
Qualifications: The Commission has seven members appointed by the Governor and confirmed by the Senate. Four FREC members must be Florida licensed real estate brokers, who each must have held an active license for five years before they join the commission. One member must be a Florida licensed broker or a Florida licensed sales associate who has held an active license for the two years preceding appointment. Two members must be people who are not, and have never been, brokers or sales associates. Commissioners are appointed for four-year terms and at least one member must be 60 years or older. Section 475.02, Florida Statutes.
Quorum: Unless otherwise provided by law, 51 percent or more of the appointed members of the Commission constitute a quorum. Section 455.207, Florida Statutes.
