Executive Order 20-139 Phase 2: Safe. Smart. Step-by-Step. Plan for FL Recovery
Executive Order 20-139 establishes the Phase 2 plan for Florida’s recovery and expands the allowable parameters of operation for several forms of business activity, including:
- restaurants and other establishments, and bars and other vendors licensed to sell alcoholic beverages for consumption on the premises, may operate at fifty (50) percent of their indoor capacity, including bar areas that may be open with seated service;
- entertainment businesses – movie theatres, concert houses, auditoriums, playhouses, bowling alleys, and arcades – may operate at fifty (50) percent of their building capacity;
- pari-mutuel facilities may seek to operate with a written request submitted from the County Mayor or County Administrator to DBPR and approval of DBPR Secretary Halsey Beshears (county requests may be submitted electronically to SafetyPlans@myfloridalicense.com); and
- personal services – tattooing, body piercing, acupuncture, tanning, and massage – may operate with appropriate safety guidelines from the Florida Department of Health.

Plan takes effect on Friday, June 5, 2020, at 12:01 a.m. The Phase 2 provisions relating to these expanded business activities do not apply in Miami-Dade, Broward, and Palm Beach counties. Executive Order 20-137: Limited Extension of Mortgage Foreclosure and Eviction Relief
Executive Order 20-137 extends Executive Order 20-94, as further extended by Executive Order 20-121, related to temporary relief from specified mortgage foreclosures and evictions, until 12:01 a.m. on July 1, 2020.
Executive Order 20-123: Full Phase 1: Safe. Smart. Step-by-Step Plan for Florida’s Recovery
Executive Order 20-123 extends and modifies Executive Order 20-112 (as modified by Executive Order 20-120) regarding the Safe. Smart. Step-by-Step. Plan for Florida’s Recovery. The order brings all Florida counties into Full Phase 1 of the state recovery plan and allows:
- restaurants and food establishments to serve patrons at indoor seating up to fifty percent of the establishment’s seating capacity, excluding employees;
- in-store retail sales establishments to operate up to fifty percent of the building’s occupancy;
- museums and libraries to operate at fifty percent of the building’s occupancy;
- gyms and fitness centers to operate up to 50 percent of the building’s occupancy with social distancing measures in effect for classes and sufficient sanitation supplies provided for a patron’s self-cleaning of surfaces and machines following each use; and
- each county to seek approval to operate vacation rentals within the county’s jurisdiction by submitting a written request and the county’s safety plan to the Secretary of DBPR (see notice to county administrators below). Executive Order 20-121: Limited Extension of Mortgage Foreclosure and Eviction Relief
Executive Order 20-121 extends Executive Order 20-94, related to temporary relief from specified mortgage foreclosures and evictions, until 12:01 a.m. on June 2, 2020.
Executive Order 20-120: Expanding Phase 1: Safe. Smart. Step-by-Step. Plan for Florida’s Recovery
Executive Order 20-120 extends Executive Order 20-112 with the modification of including Palm Beach County in the phase one recovery plan. The Order also authorizes persons in Florida to provide or obtain barber and cosmetology services in licensed establishments that adopt appropriate social distancing and precautionary measures as outlined by the Department of Business and Professional Regulation. Executive Order 20-112: Emergency Management – COVID-19 – Phase 1: Safe. Smart. Step-by-Step. Plan for Florida’s Recovery
Executive Order 20-112 establishes the Phase One Recovery path to re-opening Florida in a manner that promotes business operation and economic recovery while maintaining focus on core safety principles. The Phase 1 Recovery includes directives on responsible individual activity, restrictions on certain businesses and business services, and allowances for resumption of certain elective medical procedures. In particular, the Order provides that:
- retail establishments, museums and libraries may operate with no more than 25 percent occupancy;
- on-premises consumption of food and beverages may be allowed at restaurants while following social distancing guidelines and limiting indoor occupancy to no more than 25 percent of the building occupancy;
- sales of alcoholic beverages for on-premises consumption remain prohibited at bars, pubs and nightclubs that derive more than 50 percent of gross revenue from the sale of alcoholic beverages;
- gyms and fitness centers closed by Executive Order 20-71 remain closed; and
- prohibitions on vacation rentals in Executive Order 20-87 remain in effect for the duration of Emergency Order 20-112.

Executive Order 20-111: Emergency Management – COVID-19 – Limited Extension of Essential Services and Activities and Vacation Rental Prohibition
Executive Order 20-111 extends the vacation rental prohibitions of Executive Order 20-87 and the essential services and activities directives of Executive Order 20-91 until 12:01 a.m. on May 4, 2020.
Executive Order 20-103: Emergency Management – COVID-19 – Extending Executive Order 20-87 on Vacation Rental Closures
Executive Order 20-103 extends the effect of Executive Order 20-87 until April 30, 2020, unless extended by subsequent order. Executive Order 20-87 orders all parties engaged in rental of vacation rental properties to suspend vacation rental operations. Vacation rentals are prohibited from making new reservations or bookings and shall not accept new guests for check-in for the duration of the order. Executive Order 20-87 specifically exempts the following properties from the restrictions of the order: hotels, motels, inns, resorts, non-transient public lodging establishments, time share projects, and long-term rentals. The order also exempts vacation rentals where guests are currently staying or are scheduled to check-in no later than March 28, 2020. Rentals to persons performing military, emergency, governmental, health or infrastructure response, or travelers engaged in non-vacation commercial activities are also exempted by the order.
Executive Order 20-94: Emergency Management – COVID-19 – Mortgage Foreclosure and Eviction Relief
Executive Order 20-94 suspends certain causes of action for a period of 45 days to provide targeted, temporary relief from specified mortgage foreclosures and evictions, without relieving an individual’s obligation to make mortgage payments and rent payments.
Executive Order 20-91: Essential Services and Activities During COVID-19 Emergency
Executive Order 20-91 directs that all persons in Florida shall limit their movements and personal interactions outside of their home to only those necessary to obtain or provide essential services or conduct essential activities. The order specifies the meaning of “essential services” and “essential activities” for purposes of the conduct limited by the order. By direction of the order, the State Coordinating Officer will maintain an online list of essential services with any approved additions that will be available on the websites of the Florida Division of Emergency Management and the Florida Department of Health. The order encourages all businesses or organizations to provide delivery, carry-out or curbside service of orders placed online or via telephone, to the greatest extent practicable. The order affirms that the restrictions on restaurants and alcohol sales as imposed by Executive Order 20-68 and Executive Order 20-71 remain in effect through the duration of Executive Order 20-52, including any extensions.
Executive Order 20-89: Emergency Management – COVID-19 – Public Access Restrictions in Miami-Dade, Broward, Palm Beach, and Monroe Counties
Executive Order 20-89 orders Miami-Dade County, Broward County, Palm Beach County, and Monroe County to restrict public access to businesses and facilities deemed non-essential pursuant to the guidelines established by Miami-Dade County pursuant to its March 19, 2020 Emergency Order 07-20, and as modified by subsequent amendments and orders prior to the date of Executive Order 20-89. County administrators in these counties may determine additional “essential” retail and commercial establishments – or other institutions providing essential services – that shall not be subject to complete closure. Executive Order 20-87: Emergency Management – COVID-19 – Vacation Rental Closures
Executive Order 20-87 has been extended until May 4, 2020, by effect of Executive Order 20-111. Executive Order 20-71: Emergency Management – COVID-19 – Alcohol Sales, Restaurants, and Gyms
Executive Order 20-71 suspends the sale of alcoholic beverages by the drink or in sealed containers for consumption on the premises at all licensed alcoholic beverage vendor premises. The order provides that such vendors may continue to sell alcoholic beverages in sealed containers for consumption off the premises. The order also allows a specially licensed food service establishment to make package sales of alcoholic beverages under certain conditions, notwithstanding the restrictions in section 561.20(2)(a)4., F.S. The order provides authority for licensed alcoholic beverage vendors to request the return of undamaged products purchased for events cancelled in response to COVID-19, subject to conditions and recordkeeping requirements specified in the order. The order clarifies that retail stores and vendors that currently sell sealed containers of alcoholic beverages for off-premises consumption may continue such sales. Regarding restaurants and food establishments licensed under Chapters 500 and 509, F.S., the order suspends on-premises food consumption for customers while allowing the establishment to operate the kitchen for the purpose of providing delivery or take-out services. The order also directs the closure of gymnasium and fitness centers within the State of Florida, with exceptions for certain facilities identified in the order.
Executive Order 20-70: Emergency Management – COVID-19 – Broward and Palm Beach County Closures
Executive Order 20-70 closes on-premises service of customers at all restaurants, bars, taverns, pubs, night clubs, banquet halls, cocktail lounges, cabarets, breweries, cafeterias, and any other alcohol and/or food service business establishment with seating for more than ten people within the incorporated and unincorporated areas of Broward County and Palm Beach County. These establishments may continue to operate their kitchens for the purpose of providing delivery, pick-up or take-out services. The order does not apply to restaurants that ancillary to essential services, including airports, port facilities, secure facilities and hospitals. The order also directs the closure of all movie theatres, concert houses, auditoriums, playhouses, bowling alleys, arcades, gymnasiums, fitness studios and beaches, with exceptions for certain facilities identified in the order.
Executive Order 20-68: Emergency Management – COVID-19 – Regarding Bars, Pubs and Nightclubs; Beaches; and Restaurants
Executive Order 20-68 directs restrictions on the operations of certain bars, pubs, nightclubs, and restaurants.
Executive Order 20-52: Emergency Management – COVID-19 Public Health Emergency
Executive Order 20-52 directs the Florida Division of Emergency Management to activate the Florida Emergency Operations Center (EOC) to a Level II, to coordinate the state’s response to COVID-19.
Executive Order 20-51: COVID-19 Response Protocol and Directs Public Health Emergency
Executive Order 20-51 directs the State Surgeon General to declare a public health emergency.
DEPARTMENT EMERGENCY ORDERS
DBPR Amended Emergency Order 2020-09 – Issued July 1, 2020
DBPR Amended Emergency Order 2020-09 amends the provisions of DBPR Emergency Order 2020-09, as issued on Friday, June 26, 2020, to effectively order the following:
- vendors licensed to sell alcoholic beverages for consumption on the premises, but not licensed to offer food service, shall suspend sales of alcoholic beverages for consumption on the premises, provided that these vendors may continue to sell alcoholic beverages for consumption off the premises; and
- vendors licensed to sell alcoholic beverages for consumption on the premises, and also licensed to offer food service, may continue to operate as restaurants at 50% of seating occupancy for the service of food and beverages to customers seated at tables or bar counters with appropriate social distancing.
DBPR Emergency Order 2020-09 – Issued June 26, 2020
DBPR Emergency Order 2020-09 suspends the sale of alcoholic beverages for consumption on the premises for all vendors licensed to sell alcoholic beverages for consumption on the premises who derive more than 50% of gross revenue from the sale of alcoholic beverages. Such vendors may continue to sell alcoholic beverages in sealed containers for consumption off the premises in accordance with Executive Order 20-71, Sections 1 and 2. Licensed restaurants may continue to operate for on-premises consumption of food and beverages at tables pursuant to the restrictions in Executive Order 20-139, so long as these vendors derive 50% or less of gross revenue from the sale of alcoholic beverages for on-premises consumption. DBPR Emergency Order 2020-09 takes effect on the date of filing, June 26, 2020.
DBPR Emergency Order 2020-08 – Issued June 9, 2020
DBPR Emergency Order 2020-08 extends deadlines for examination eligibility and licensure eligibility through December 31, 2020, for professional licenses regulated pursuant to Chapter 455, Florida Statutes, and the related professional practice acts. The Order supersedes section 4 of DBPR Emergency Order 2020-03, which had previously extended these deadlines through May 31, 2020.
DBPR Emergency Order 2020-07 – Issued May 31, 2020
DBPR Emergency Order 2020-07 suspends the existing renewal deadline of any license issued by the Florida Real Estate Commission to December 31, 2020, for real estate licenses with an existing renewal deadline between June 1, 2020, and December 31, 2020. Late fees will not be assessed on eligible license renewals during this extended time period. This order also extends the deadline for any continuing education hours that are an existing condition of renewal to December 31, 2020. DBPR Emergency Order 2020-07 implements an extension of renewal deadlines that is necessary to accommodate the universal hardship exemption for end-of-course examinations as adopted by the Florida Real Estate Commission on May 19, 2020, in its Order Establishing Hardship Exemption and Extending Deadline for End of Course Examinations.
DBPR Emergency Order 2020-06 – Issued May 20, 2020
DBPR Emergency Order 2020-06 establishes an expiration for certain provisions of DBPR Emergency Order 2020-04, including sections 1-5 related to the emergency powers of a board of a condominium, cooperative, or homeowners’ association and sections 6-9 related to the tolling of time requirements for the filing of certain financial statements of condominium associations, cooperative associations, and timeshare plans. As of June 1, 2020, sections 1-9 of DBPR Emergency Order 2020-04 shall cease to be operational. The order also extends the waiver of the assessment of harbor pilots in section 10 of DBPR Emergency Order 2020-04 for May, June, and July 2020.
DBPR Emergency Order 2020-05 – Issued April 30, 2020
DBPR Emergency Order 2020-05 supersedes DBPR Emergency Order 2020-01 and suspends the renewal deadline until June 1, 2020, for any license, permit, registration, or certificate issued by DBPR that has an existing renewal deadline in March, April, or May 2020. The order also suspends the deadlines related to continuing education conditions of renewal for these license holders through June 1, 2020.
DBPR Emergency Order 2020-04 – Issued March 27, 2020
DBPR Emergency Order 2020-04 suspends certain conditions of the emergency powers of the association board of a condominium, cooperative, or homeowners’ association to allow the exercise of these powers during the state of emergency unless specifically prohibited by the provisions of the association’s governing documents. The order suspends and tolls the timing requirements pertaining to the preparation, submittal, or filing of certain financial reports and statements of a condominium association, cooperative association, or timeshare plan. The order waives the assessment of pilotage earned by harbor pilots for March and April, 2020, and extends the deadline for the filing of a harbor pilot’s annual earnings statement from April 15, 2020, to July 15, 2020. The order suspends any restriction of chapter 474, F.S., or chapter 61G-18, F.A.C. which would prohibit an active Florida-licensed veterinarian from practicing telemedicine on a patient.
DBPR Emergency Order 2020-03 – Issued March 23, 2020
DBPR Emergency Order 2020-03 suspends and tolls through May 31, 2020, the following: all time requirements, notice requirements, and deadlines for final agency action on applications for permits, licenses, rates, and other approvals under any statutes or rules for which such applications are deemed approved unless disapproved in writing by specified deadlines; all final orders reflecting final agency action; all time requirements, notice requirements and deadlines for filing responses to notices of intended agency action pursuant to s. 120.569, Florida Statutes; and all deadlines for licensure eligibility and examination eligibility.
DBPR Emergency Order 2020-02 – Issued March 23, 2020
DBPR Emergency Order 2020-02 suspends the provisions of section 499.006(9), Florida Statutes, as they relate to the expiration date of personal protective equipment (PPE) that is worn to minimize exposure to hazards that cause serious workplace injuries or illnesses, including filtering facepiece respirators such as N-95 respirators and surgical masks.
DBPR Emergency Order 2020-01 – Issued March 16, 2020
DBPR Emergency Order 2020-01 suspends the license renewal deadline for a period of 30 days following the existing renewal deadline for any license, permit, registration, or certificate with an expiration occurring in March or April. The order also provides that license renewal requirements for completion of continuing education, if applicable, are also suspended for the same time period.

Construction Industry Licensing Board Expands Online Continuing Education
The Construction Industry Licensing Board is allowing all continuing education courses previously approved for classroom (in-person) credit to now be eligible to be taught via interactive distance learning methods. Continuing education course providers will not be required to submit separate course applications for distance learning during this time. This waiver of Rule 61G4ER20-6, is effective June 18, 2020, and valid for the next 90 days
National Council of Architectural Registration Boards – Testing Center Reopens for Architectural Registration Exam
Beginning June 9, 2020, candidates can schedule Architectural Registration Exam appointments at Prometric test centers in North America that offer “All Programs” or “Essential Only” services. Licensure and Exam Eligibility Deadlines Extended by DBPR Emergency Order 2020-08
By effect of DBPR Emergency Order 2020-08, issued June 9, 2020, all deadlines for licensure eligibility and examination eligibility are suspended and tolled through December 31, 2020, unless extended by subsequent order. The Order supersedes section 4 of DBPR Emergency Order 2020-03, which had previously extended these deadlines through May 31, 2020.
Licensing Examinations Now Available Through Pearson VUE Professional Centers
As of May 1, 2020, candidates may begin scheduling exams at the following Pearson VUE testing locations: Boynton Beach, Doral, Ft Lauderdale (2), Fort Myers (2), Gainesville, Hollywood, Jacksonville, Lake Mary, Lakeland, Melbourne, Miami, Orlando, Ormond Beach, Pensacola, Sarasota, St. Petersburg, Tallahassee, and Tampa. In addition to these test center locations, the Pearson VUE sites that have been available for essential services exams since April 16, 2020, will remain open to DBPR candidates, including: Deerfield Beach; Gainesville; Jacksonville; Miami; Orlando; Plantation; Port Charlotte; Tallahassee; and Tampa. All DBPR licensing exams administered by Pearson VUE have been included in the essential services exams group, including examinations for: Asbestos, Auctioneer, Barber, Building Code, Community Association Manager, Construction (except plumbing), Cosmetology, Electrical, Landscape Architect, Real Estate, Real Estate Appraiser, Veterinary Medicine, and Drugs, Devices and Cosmetics. National Council of Architectural Registration Boards – Testing Center Closures for Architectural Registration Exam
Prometric test centers in North America are anticipated to remain closed through May 31, 2020, except for exams for essential services programs made available where feasible. To view Prometric’s determination of exams related to essential services programs, review the Prometric Essential Client Programs List. NCARB is recommending that candidates reschedule any exam appointments impacted by these closures for a date in fall or early winter to avoid further disruption. All rescheduling fees for these exams have been waived until further notice. Construction Industry Licensing Board – April 2020 Plumbing Exams To Be Rescheduled
The Construction Industry Licensing Board has canceled the plumbing examination originally scheduled for April 14-15, 2020, in Kissimmee, Florida. The examination will be rescheduled in either June or August, 2020. National Association of State Boards of Geology – March 2020 Exam Rescheduled to October 2020
The Association of State Boards of Geology exam scheduled for March 20, 2020, in Kissimmee, Florida, has been rescheduled to October 2, 2020.

Florida Business Damage Assessment Survey
The Florida Business Damage Assessment survey has been activated to assess the impact of COVID-19 on Florida’s local business operations. The survey, managed by the Florida Department of Economic Opportunity (DEO), will evaluate businesses affected by COVID-19 and the impacts the virus has had on the local economy so actions to implement appropriate relief programs can begin. Florida Small Business Emergency Bridge Loan Program
The Florida Small Business Emergency Bridge Loan Program is currently available to small business owners located in all Florida counties statewide that experienced economic damage as a result of COVID-19. Reemployment Assistance Program Resources Administered Through Florida Department of Economic Opportunity

U.S. Small Business Administration Disaster Loans
The Small Business Administration (SBA) has announced that Florida small businesses that are being economically impacted by COVID-19 can now apply for low-interest Economic Injury Disaster Loans. Loans of up to $2 million are available to help meet financial obligations and operating expenses for small businesses statewide that have been impacted since January 31, as well as for private non-profit organizations of any size, small agricultural cooperatives and small aquaculture enterprises. Florida Small Business Development Center – Disaster Recovery Consulting Services
The Florida Small Business Development Center (FSBDC) provides no-cost, one-on-one confidential consulting to help small businesses prepare disaster loan applications and assist with other post-disaster challenges. U.S. Small Business Administration Paycheck Protection Program
The Small Business Administration (SBA) Paycheck Protection Program is a loan designed to provide a direct incentive for small businesses to keep their workers on the payroll. SBA will forgive loans if all employees are kept on the payroll for eight weeks and the money is used for payroll, rent, mortgage interest, or utilities. The Florida Department of Revenue has extended certain filing deadlines for Florida businesses related to sales and use tax, tourist development tax, solid waste fees, and prepaid wireless E911 fees.
