Child Labor Waiver

This is not a Work Permit. Work Permits are issued in Florida for the entertainment industry only. A waiver of the child labor law is needed when minors want to work in the regular workforce beyond the limits of the state law. DBPR reviews waiver requests from those minors who are no longer enrolled in the public school K-12 programs. School Districts are responsible for issuing waivers for those students still enrolled in the public school K-12 programs. A waiver is not required during the summer session.

Application Requirements:
 
  • AGE: Minors 14-17 years of age.
  • FEE: None.
  • APPLICATION: Waivers are granted on a case-by-case basis when a minor wishes to work beyond the limits of the state child labor law. To apply for a waiver application, click on the "Online Service" link below or apply mail, email, or fax by using the "Printable Application" link at the bottom of the page.
  • WHO CAN APPLY?: DBPR reviews waiver requests from those minors who are no longer enrolled in the public school K-12 programs. School Districts are responsible for issuing waivers for those students still enrolled in the public school K-12 programs. While it is the minor's waiver request, employers, family members or friends may assist the applicant in completing the application.

  • WHEN ARE WAIVERS GRANTED?: When it clearly appears to be in the best interest of the minor, the department may grant a waiver of the restrictions imposed by the State Child Labor Law.
  • INSTRUCTIONS:The second page of the application contains the waiver criteria and instruction to help complete the application. If you have questions about completing the application you may call us for assistance at 1.800.226.2536 or 850.488.3131.
  • SUPPORTIVE DOCUMENTS: The waiver supportive documentation requirements are located on the second page of the application. They will vary based on the type of waiver request. Please do not mail original documents. We accept copies by mail, emails, or faxes. Tip: Small copied documents are hard to read. Consider enlarging small documents before submitting them through the fax.
  • WHERE TO SEND? Once completed, fax the application and the supportive documents to the Child Labor Section for approval to 1.850.487.4928, email to Childlaborwaivers@myfloridalicense.com or mail to the address provided in the application package.
