Apply for a New Seating Establishment License (Plan Review has been Approved)

Florida law requires owners of new public food service and new owners of existing establishments to obtain a license from the division before operating. The application process described below is for a new Seating Food Service Establishment license.

Application Requirements:
  • Eligibility: If your operation does not meet the following definition, please return to the previous page to select the correct one.

    Seating - Permanent seating establishments are those fixed public food service establishments that provide and maintain accommodations for consumption of food on the premises of the establishment or under the control of the establishment. The operator of the establishment must provide the number of seats available to the public to the division prior to licensing for fee calculation purposes. The division does not authorize the number of seats. For seating levels and changes to seating, the applicant must obtain wastewater approvals from the Florida Department of Health, Florida Department of Environmental Protection or the local utility authority. The local authority having jurisdiction must approve fire safety issues relating to seating levels. [Rule 61C-1.002(5)(b), Florida Administrative Code (FAC)]

  • Your Online Account: This online application is only available through your Online Account. If plan review has been submitted by mail, you want to link the approved plan review to your account.

  • License Fees: Annual license fees are listed on our food service fee webpage and are based in part on the county your establishment is located and when you wish to open. The division divides the state into 7 licensing districts according to county. Licenses expire each year at the following times:

    • District 1 - October 1
    • District 2 - December 1
    • District 3 - February 1
    • District 4 - April 1
    • District 5 - June 1
    • District 6 - June 1
    • District 7 - December 1

  • If applying less than six months prior to the expiration date, the fee is prorated to the half-year fee. If applying more than six months prior to the expiration date, the fee is the full-year fee. For help determining the correct fees please use our license fee calculator.

  • Opening Inspection: All new licensees are required to pass a sanitation and safety inspection prior to opening. After meeting all plan review requirements and submitting your license application and fees, please contact the department at 850.487.1395 to schedule an opening inspection.
