Violations:
A summary of the violations found during the inspection are listed below. The department cites violations of Florida's sanitation and safety laws, which are based on the standards of U.S. Food and Drug Administration's Food Code. High Priority violations are those which could contribute directly to a foodborne illness or injury and include items such as cooking, reheating, cooling and hand-washing. Intermediate violations are those which, if not addressed, could lead to risk factors that contribute to foodborne illness or injury. These violations include personnel training, documentation or record keeping and labeling. Basic violations are those which are considered best practices to implement. While most establishments correct all violations in a timely manner (often during the inspection), the division's procedures are designed to compel compliance with all violations through follow-up visits, administration action or closure when necessary.

14-01-5    Basic - Bowl or other container with no handle used to dispense food. In raw food reach in cooler on cook line, plastic serving bowl used as scoop in raw chicken. Operator removed bowl from product. Also, in walk-in cooler plastic serving bowl used a scooper in salsa. Operator removed bowl from product. **Corrected On-Site** **Repeat Violation**
36-34-5    Basic - Ceiling/ceiling tiles/vents soiled with accumulated food debris, grease, dust, or mold-like substance. Multiple vents and surrounding ceiling tiles throughout kitchen soiled with dust. **Repeat Violation**
14-11-5    Basic - Equipment in poor repair. Interior of walk-in freezer metal is pulled back and showing insulation of door. Also, multiple gaskets in establishment torn/in disrepair. **Repeat Violation**
36-73-4    Basic - Floor soiled/has accumulation of debris. Floor under fryers soiled with grease. Also, floor under cook line equipment soiled with build up. **Repeat Violation**
36-17-5    Basic - Floor tiles missing and/or in disrepair. Multiple tiles on cook line/under fryers missing or in disrepair. Also, multiple tiles in walk-in cooler missing/in disrepair. **Repeat Violation**
14-69-4    Basic - Ice buildup in reach-in freezer and/or walk-in freezer. Ice buildup up in floor of walk-in freezer. **Repeat Violation**
10-01-5    Basic - In-use utensil in non-time/temperature control for safety food not stored with handle above top of food within a closed container. On bottom shelf of server line, in bucket of sugar handle of measuring cup inside product. Operator removed handle from product. **Corrected On-Site**
31B-04-4    Basic - No handwashing sign provided at a hand sink used by food employees. No handwash sign in men's restroom. Provided operator with handwashing signs via email. **Repeat Violation**
23-03-4    Basic - Nonfood-contact surface soiled with grease, food debris, dirt, slime or dust. Multiple gaskets soiled throughout kitchen. Also, on soda machine on server line, around nozzles soiled with black build up. Also, interior of unused reach in cooler at end of bar soiled with liquid and brown stains. **Repeat Violation**
25-06-4    Basic - Single-service articles not stored inverted or protected from contamination. On top shelf of cook line, metal to go containers not inverted. Operator and one employee filled all stacks of containers over. **Corrected On-Site** **Repeat Violation**
29-49-6    Basic - Standing water in bottom of reach-in-cooler. In bottom of raw food reach in cooler on cook line standing water.
08B-12-5    Basic - Stored food not covered. Full tea urns at server line not covered. Operator had employee put aluminum foil over top of tea urns. Also, in back near office, two containers of wheels with rice and beans do not have lids for containers. Operator covered with plastic wrap. **Corrected On-Site** **Repeat Violation**
36-50-4    Basic - Unclean building components, attachments or fixtures. In walk-in cooler, fan covers of ac unit have build up of dust.
42-01-4    Basic - Wet mop not stored in a manner to allow the mop to dry. By handwash sink at server line, mop stored in mop bucket with dirty water. Operator emptied mop bucket and hung mop up to dry. **Corrective Action Taken**
21-38-4    Basic - Wiping cloth sanitizing solution stored on the floor. At bar area, sanitizer bucket stored on floor by handwash sink. Operator removed from floor and moved to cook line on shelf. **Corrected On-Site**
02D-01-5    Basic - Working containers of food removed from original container not identified by common name. On bottom shelf of server line, bucket of sugar not labeled. Operator labeled bucket. **Corrected On-Site**
35A-02-7    High Priority - Live, small flying insects found. Observed 2 live flying insects in chemical room by floor drain. Also, observed 2 live flying insects near unused reach in cooler at end of bar. **Repeat Violation** **Admin Complaint**
08A-05-6    High Priority - Raw animal food stored over/not properly separated from ready-to-eat food. In walk-in cooler, ziplock bag of raw fish stored in metal pan on shelf above open containers of cut vegetables. Operator moved raw fish to bottom shelf. Also, in walk-in cooler, commercially packaged chicken stored on top shelf above all ready to eat foods. 03A-02-5    High Priority - Time/temperature control for safety food cold held at greater than 41 degrees Fahrenheit. In reach in cooler at end of cook line near fryers, cut lettuce (51F - Cold Holding); breaded chicken tenders (48F - Cold Holding). Operator stated product was put in cooler approximately 1 hour prior at open. Cut lettuce is filled over fill line. Chicken in pull out drawer with gasket in disrepair. 03F-02-5    High Priority - Time/temperature control for safety food identified in the written procedure as a food held using time as a public health control has no time marking. On cook line in white bucket in front of grill, cut tomatoes held on time as a public health control not time marked. Operator stated they were put at 30 minutes prior and put time marking on container. **Corrected On-Site**
41-10-4    High Priority - Toxic substance/chemical improperly stored. On metal storage rack next to ice machine in hallway, raid bug spray stored on bottom shelf next to ice bags. Operator removed bug spray and put in office. **Corrected On-Site** **Repeat Violation** **Admin Complaint**
02C-03-5    Intermediate - Commercially processed ready-to-eat, time/temperature control for safety food opened and held more than 24 hours not properly date marked after opening. In walk-in cooler, gallon of milk with no date marking. Operator stated it was opened yesterday morning when queso was made. Operator marked container with date mark. **Corrected On-Site**
11-27-4    Intermediate - Establishment has no written procedures for employees to follow in response to a vomiting or diarrheal event where the vomit or diarrhea is discharged onto surfaces in the establishment. Operator unable to provide written procedures in event of vomiting or diarrhea. Emailed copy of DBPR form 5030-104 to operator.
31A-11-4    Intermediate - Handwash sink used for purposes other than handwashing. In handwash sink at end of cook line near fryers, multiply utensils in handwash sink. Operator removed dishes. Also, in dish area handwash sink, bucket of blue liquid in sink. Operator removed bucket from sink. Also, in server area handwash sink near soda machine, multiple dishes in sink.
