The department cites violations of Florida’s sanitation, licensure and safety laws
which are based on Florida Statutes and the Florida Administrative Code. Violations
are handled in various ways depending on the severity as prescribed by the laws and
rules. Minor violations may be handled by the issuance of a Notice of Non Compliance
and do not become public record if they are corrected within the prescribed timeframes.
Other violations, such as unlicensed activity, are handled by the issuance of a
citation which is a monetary penalty that is resolved much like a traffic citation.
Other more serious violations are dealt with by the board or the department and can
include fines, probation, suspension or revocation. Most disciplinary cases against
licensed establishments and professionals are confidential until 10 days after a
